The Hot Springs Village POA Board sent out the following Board Brief regarding the pickleball windscreen situation:

HSVPOA BOARD BRIEF #27 – Dec. 5, 2022

In the past several months, the Board has found it necessary to take actions to ensure that all amenity-related clubs and organizations are treated equally and to ensure that our governing documents are being followed consistently and correctly. It should be remembered that the Board is responsible for the governance of close to 16,000 residents and the Pickleball Club membership makes up only about 3% of that population.

Recently, social media has abounded with misinformation regarding one of the HSVPOA-owned facilities – the pickleball courts – and the club that uses those courts. In an effort to provide actual facts and clarity on the rules that guide this Village, the Board of Directors presents the following narrative, which continues on the attached document:

HSVPOA strives to be fair and consistent with all Hot Springs Village clubs and organizations related to practices on Common Property and related member assets. There has been considerable discussion regarding the sale and placement of advertising/sponsorship signage on the windscreens at the HSVPOA pickleball courts, as well as club affiliated signage and merchandising at the DeSoto Recreation Center facility located at the DeSoto Recreation Area.

BACKGROUND

On November 13, 2018, a permit application was requested by the POA Recreation Department, at no charge, for windscreen sponsorship for the pickleball courts. According to the application the windscreens were to be 34” wide and 6’ in height. Noted the application, “They should be standard commercial grade and blue in color. Sponsor logo will be centered in screen with white lettering. Logo will take up no more than one third of the height of the screen (2’) and proportionate to the width according to the lettering needs. All future sponsorship screens will be uniform and all non-sponsor screens will be uniform without a logo.”

Further noted the application, “A sponsor may renew at the expiration of each term or a screen meeting the same standard may be replaced with a new sponsor. All sponsorship monies are to be spent on the facility only and the POA (outdoor Rec) will receive a financial report quarterly. Each screen is a two –year term for $1,500. No business details other than company name and logo will be placed on the screen.”

The ACC provided final approval for the permit on December 16, 2018. On December 19, 2018, it was noted in the COO report that staff is working with the Pickleball Club for tournament play in 2019. Both windscreens and gate signs have been approved as a fundraiser for the Pickleball Club to purchase additional seating and shade. To the knowledge of HSVPOA staff affiliated with the ACC, and upon review of ACC minutes, there have been no further requests for ACC approval of any additional windscreen sponsorship signage after the initial approval of the signs included in the permit approved in December 2018.
