Twenty-three small permits were discussed (one was concept only), with four being denied. Three new home builds were approved, and one was denied because the design was too contemporary. A property owner unhappy with the ACC’s decision to disallow parking behind his house said he has been parking there since 2002.

Committee Members present at the May 2, 2024, Architectural Control Committee Meeting were Larry Brocaw (Chair); Brian Whitehead (Vice-chair); Lanny Beavers; Clint Blackman III: John Hyduke; Jared Robinson; and Gary Belair, BOD Liaison.

Staff present were Matt Broom, Associate Director of Public Services; Beverly Ellison, Supervisor Permitting and Inspections; Ginger George, Contracts and Development Supervisor; and Tom Benfield, Community Support Manager. George will take Broom’s place as the staff liaison.

Staff Guests present were Community Support Officers Danny Stephens and Chris San Filippo.

Property Owner John Crotty brought donuts for everyone to enjoy.

Belair said other Board Members will visit the committee from time to time.

Property Owner Unhappy With Decision and Will Appeal

64 Durango Way – The Property Owner said he has received six or eight citations from Community Support for parking in the back of his house on the gravel. He said he purchased the house in 2002, and the gravel was already there at the time of purchase. “If y’all want to come and move it, you can,” stated the Property Owner. He said he built an addition to his home eighteen years ago with a deck off of the addition. He parks his golf cart under the deck. He said that Community Support also said he could not park the golf cart under his deck.

Community Support Manager Tom Benfield stated, “This is one the committee looked at last month, I think. He has gravel in the back, but that is not the issue. Initially, there was a vehicle parked on it, followed by a golf cart trailer.”

The Property Owner said, “The golf cart trailer was not on it, and the golf cart was under the deck.”

Benfield stated, “The golf cart trailer was in your backyard.”

The Property Owner agreed it was parked in the grass in the backyard.

Benfield: “This committee agreed with the Rules and Regulations, saying that none of those items can be back there, and passed that message on to a Community Support Officer, who then relayed that message, saying he could not park those items in the back of the house.”

Property Owner: “They’ve been there 22 years. I do not understand why you’re making these rules up, and everybody has to comply with them.”

Chair Larry Brocaw stated, “We don’t make the rules. The Board of Directors makes the rules.”

Property Owner: “It was never a rule before.”

Brocaw: “I am just telling you, we don’t make them. The Board of Directors makes them and then we follow them.”

Board Member and Committee Liaison Gary Belair said, “There is an appeals process. That is your next step.”

Benfield asked the Property Owner if he had received a fine notification.

The Property Owner said he had not.

Benfield said, “We will go ahead and fine you, so you can start the appeal process. That goes through the General Manager for review. Then, if he sides on the side of the Rules and Regulations, then you can take it to the Board of Directors for an appeal.”

Property Owner: “I was told I could come here and talk to you, and I could get people to come and look at this and get an exception.”

Brocaw: “We have already voted on this. There is no reason to go back out and look at it a second time.”

The Property Owner will appeal to the Board to leave all items as they are in his yard.

21 Captura Circle – Fire Pit – Permit approved.

22 Nina Drive – Patio Cover – Permit approved.

22 Nina Drive – Fencing – Permit denied. Resubmit the drawing showing the exact location.

39 Loyola Drive—Black decorated metal fence—The house is built almost to the setback line, so there is no option except to install the fence in the setback. If the fence needs to be removed for utility access, then it is up to the Property Owner to cover the removal cost. The permit has been approved with a variance for the corner of the fence in the 20-foot setback.

12 Laguna Way – Landscaping – Permit approved.

44 Valencia Way – Landscaping – Permit approved.

67 Arjona Way – Landscaping – Retaining wall – Permit approved.

11 Roseta Lane – Exterior Paint – Property Owner provided paint samples – Committee will discuss in executive session. On hold for now. Permit denied.

27 Lazo Place – Dock – Permit approved.

27 Lazo Place – Patio Cover – Permit approved.

58 Murillo Way – Landscaping for new build – Verify the size of gravel at the back – should be 8″ – 12″. Permit approved.

93 Fineza Way – Ornamental Fencing CONCEPT – Concept approved. Variance – need better drawing to show exact fence.

2 Coronado Drive—Patio Cover—The Property Owner wants to install a 9′ x 12′ covered gazebo. The permit has been approved.

3 Provecho Lane – Landscaping – Permit approved.

4 Levantino Lane—Fencing—Permit denied by a vote of 4 to 3. Resubmit.

70 Marinero Way – Dock – Permit approved.

4 Narvaez Way – Deck – Permit approved.

14 Excelso Lane – Dock – Permit approved.

16 Fiero Lane—Patio Enclosure—The Permit was approved. The color of the roof to match the house. John Hyduke abstained from voting.

19 Jabali Lane – Deck and Cover – Permit approved.

14 Largo Drive – Bridge – Permit approved.

17 Vista Lane – Patio Cover – Permit approved.

37 Elcano Drive – Screening – Permit approved – Six-foot tall privacy screen installed 12′ section of fence.
